OMIG Webinar #3: Self-disclosure by Medicaid Providers

The New York Office of Medicaid Inspector General issued self-disclosure guidance for Medicaid providers on March 12, 2009 (available at www.OMIG.NY.gov). The self-disclosure guidance followed consultation with health care providers and industry professionals, and was designed to give providers an easy-to-use, predictable method for disclosing overpayments.
Since the guidance was issued, self-disclosure and repayment of overpayments within 60 days of identification has become mandatory for Medicare and Medicaid providers under section 6402 of the Patient Protection and Affordable Care Act (PPACA) of 2010 (effective March 23, 2010), and a mandatory part of New York's compliance programs under 18 NYCRR 521 (effective October 1, 2009).
This Webinar will review the self-disclosure guidance, and New York's experience with self-disclosure by Medicaid providers since the issuance of the guidance, including fact patterns, process, and outcomes. Since the beginning of 2010, the OMIG has received 111 disclosures-compared to 59 disclosures in 2008.
The Webinar will also address the implications of a Medicaid provider's failure to make self-disclosure of identified overpayments under the New York False Claims Act amendments (Laws of New York 2010, Chapter 379) signed by Governor David A. Paterson on August 23, 2010.
NOTE: During the Webinar, OMIG speakers will not identify specific providers who have made disclosures.
